Privacy Policy

This is the privacy policy of Pomona Fruits Limited. This policy sets out our procedures regarding the collection and use of your personal information when we send you information in the post, when we contact you electronically and when you access our website www.pomonafruits.co.uk

Our commitment to you

We promise to always safeguard your privacy and personal information. We will keep your personal information safe and will never pass it to third parties for marketing purposes without your explicit consent.

Who is responsible for processing your personal data?

Pomona Fruits Ltd is the Data Controller. This is the legal entity responsible for how your personal data is collected, stored and processed.

Managing your personal data

When you share your personal information with us, you have a right to expect that information to be treated with total confidentiality. Therefore, it is our responsibility to manage your personal data that you provide to us with care and in accordance with all data protection legislation and industry best practice.

Whether you have supplied your personal details via our website, over the phone, by email or in a letter, we will never use this information without a lawful reason to do so. We will use your personal data for the purposes for which it was initially requested and as fully explained in this Privacy Policy.

It is your responsibility to ensure that the personal data you provided to us is accurate and up to date. You can update your personal contact details, including address, phone number and email address by emailing us at [email protected] or telephoning us on 01255 440410. In addition to this, if you have an online account with us, you will also need to update your personal details there by logging in to your account with your email address and password.

How we use your information

We use your personal information in a number of different ways. Below we set this out in detail, showing what we do, and why we do it.

Using your personal data to process and deliver your order

We use your name, address and contact details to process and deliver your order so that we can complete our contract with you. We may use your details to contact you by telephone, email or by post if there is a query with your order, to send an order confirmation or to advise you that your order is on its way. The legal basis for processing is legitimate interest.

Using your payment information to process your order

We use your debit/credit card information to take payment and to issue refunds. We process all card payments in line with our obligations under the PCI-DSS regulations and will encrypt your payment details before sending to our card payment and banking provider. The legal basis for processing is legitimate interest.

Using your personal data for direct marketing purposes

Based on the marketing preferences you have selected and therefore only with your consent, we will use your email and/or postal address to send you details of our latest products and promotions. We may also use marketing profiling techniques to determine what product offers may be of interest to you whether that be by email or direct mail. The legal basis for processing is legitimate interest.

We will obtain your consent to send you details of our latest products and promotions via post or email in a number of ways. We will obtain your consent when you make a purchase from us, request a catalogue or sign up to our email newsletters. You can change your marketing preferences at any time – see paragraph below on changing your marketing preferences.

Sharing your information with third parties

We will share your data with companies that provide services on our behalf as an essential part of being able to provide our goods and services to you. Companies include payment processors, suppliers, couriers, printers and analytical processors. Any third party that communicates with you on our behalf must only do so for the purpose of carrying out the services we have requested and not for the purpose of direct marketing their own products and services. The legal basis for processing is legitimate interest.

We think you may enjoy some of the latest products and offers by post from trusted retailers and organisations. However, we will only pass your data to third parties for marketing purposes if we have your explicit consent and we will never pass your telephone number or email address on to a third party for their own marketing purposes. The legal basis for processing is legitimate interest.

We work with Epsilon Abacus (registered as Epsilon International UK Ltd) a company that manages the Abacus Alliance on behalf of UK retailers and charities. The participating retailers are active in the gardening, clothing, collectables, food and wine, gadgets and entertainment, health and beauty, household goods and home interiors and travel categories. They share information on what their customers buy. Epsilon Abacus analyses this pooled information to help the retailers understand consumers’ wider buying patterns. From this information, retailers can tailor their communications, sending people suitable offers that should be of interest to them, based on what they like to buy.

We may share your personal information with third parties where required or permitted by law if we believe we need to do so to protect our rights and interests, or to comply with legal proceedings. In such cases, we will always do so legally and with due regard to privacy.

I am not a Pomona Fruits customer, how did you obtain my details?

From time to time we source postal contact details of prospective customers from the Abacus Alliance (mentioned in the section above "Sharing your information with third parties"). We use this information to send our latest catalogue to individuals who we believe might be interested in our products. We process this data under legitimate interest. If you’d prefer that your details were not shared for this purpose, please contact Epsilon Abacus by calling 020 8943 8049 or emailing [email protected].
